Terms and conditions

All bookings made via apartments-for-rent.com are booked under these terms and conditions and the basis upon which Opao agrees to provide services in connection with the renting of residential accommodation, property or other services to guests.

To make a reservation you should complete the booking form and confirm online.

Terms of Business

A minimum of two nights applies to all bookings.

Guests will be required to complete a booking form. Any person booking on behalf of a guest shall be taken as booking principal and is liable for the guest(s), and will be referred to as ‘guest’ in the reminder of these terms. All guests agree to indemnify Opao for any breach, non-payment, loss or damage caused by such guest. Any guest who causes damages to the accommodation in the widest sense of its meaning agrees to an upfront charge of € 1000,- Any excess charge will be reimbursed after an estimate off costs have been made up by a third party. Any excess costs, quoted/confirmed by a third party, due to the guest will be reimbursed by the guest and the guest allows Opao to charge his credit card accordingly

Payment Methods and Procedures

25% of the reservation fee will be charged as a non-refundable deposit at the moment of making a confirmed booking on the guests credit card. No more than 48 hours prior to arrival the remaining reservation fee and bookings charges will be charged to the guests credit card. The booking charges added to the reservation fee are for non accommodation fees such as: transport, cleaning, bank and credit card charges.

All bookings which are quoted on our website are charged in local currency, which is Euro’s for most European countries. All payments must be made by credit card If payments are not received within the required time, or credit card charges are refused by the issuing card company Opao reserves the right to cancel the booking. In all cases where payments can not be processed automatically Opao reserves the right to charge administration fees, with a minimum of € 12,-

Amendments

A € 30 administration charge will be charged for any amendment made once a booking has been confirmed.

Credit Cards

We accept all major credit cards.

Security Deposit

Credit Card imprints may be required on or prior to arrival to cover the cost of any phone calls or extras. Telephone accounts and any extras must be settled in full prior to departure.

Clients should be aware that they will be liable for any damages or breakages caused whilst in the accommodation. At some apartments a security deposit will be required in connection with the booking and the deposit shall be security for any damages or breakages caused to the accommodation. You will be notified if this is applicable.

Cancellation Policy

Cancellation Policy The cancellation policy is divided in two specific policies in reference to the length of stay. We make a difference in cancellation fees for bookings of up to 1 month and booking of more then a month. The main reason for doing so is the fact that the financial risk on our side is much larger for longer reservation. A cancellation made more than 48 hours prior to arrival will not be charged, however the deposit is non-refundable and will thus not be reimbursed.

Refunds (partial) for cancellations, less an administration charge of €30, may apply in the event that the apartment is re-let.
No shows are charged 100% of reservation costs.

Check in / Check out

In most cases, check in is after 3.00 pm and check out is before 11.00 am.

Personal Data

Opao does not disclose personal data to third parties other than as permitted. Opao operates a data protection policy.

Disclaimer and Quality

Opao has taken reasonable care to ensure the quality of the accommodation and properties offered and cannot accept any liability for any dissatisfaction with regard to the properties. Unless expressly stated to the contrary by Opao in writing, Opao acts as an technical intermediary for principals.

Opao reserves the right to alter prices or accommodation without notice due to circumstances beyond Opao’s control.

Opao acts as an technical intermediary in good faith and cannot be held responsible for any acts/defaults caused by third parties or any legal liability of any landlord or owner.

Opao recommends that clients purchase travel insurance.

Opao does not warrant, guarantee or undertake any matters on behalf of any third party supplier or any landlord of any property.

Details of the landlord or owner will be given on request.

Every effort has been taken in the compilation of Opao’s marketing materials, but Opao cannot accept responsibility for any errors in such material which is intended for guidance only. The photographs in Opao's marketing materials have been provided by the owners of the properties as an example of their accommodation and do not necessarily represent the apartment type or accommodation booked.

Intermediary Letting

Opao acts as technical intermediary for landlords and owners of residential properties. Unless expressly stated to the contrary in writing, Opao enters into contracts for the letting of property with guests or tenants either as technical intermediary for a named principal or as technical intermediary on behalf of an undisclosed principal.

In no circumstances will Opao be liable to any tenant in respect of any property or relating to any damage or defect in the property, breach of any tenancy or letting agreement and any other breach by or on the part of the landlord.

Warranties and Liability

Opao will provide the Services using reasonable care and skill. Except in respect of death or personal injury caused by Opao’s negligence, or as expressly provided in these Conditions, Opao shall not be liable for any direct, indirect or consequential loss which arises out of or in connection with the accommodation or the provision of the Services or their use. All other warranties terms and conditions, expressed or implied by statute or otherwise, are excluded to the fullest extent permitted by law.

The entire liability of Opao to any person shall not in any event exceed the amount of the charges paid to Opao. The liability of Opao shall be pro-rata and only relate to the unused portion of the stay as from the date of the claim.

Opao shall be fully indemnified by guests and tenants against any loss claim or liability whatsoever incurred or suffered by Opao as a result of negligence or any default by any person, guest or tenant (or their employees, agents or representatives) of their obligations to Opao however arising in connection with any property or the Services.

Force Majeure

Opao shall not be liable to any person by reason of any delay or failure to perform any of Opao's obligations under the Contract if the delay or failure was due to any circumstances or cause beyond Opao's reasonable control.

Termination

The Contract may be terminated by Opao if the other party to the Contract commits any material breach of any term of these Conditions and which (in the case of a breach capable of being remedied) shall not have been remedied within two (2) days of a written request to remedy the same.

Opao may terminate the Contract immediately upon notice if payment of any sum due to Opao is not made on the due date.

General

Opao may assign the Contract at any time or employ sub-contractors for carrying out any part of the Services.

If any provision of the Contract is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of the Contract and the remainder of the provision in question shall not be affected.

The law in the country of the real estate shall apply to the Contract and the parties submit to the exclusive jurisdiction of the local courts.
